65 Possessing or using particular nets for taking fish—particular regulated waters
This section applies to the following regulated waters—
• Yeppoon–Keppel Bay–Fitzroy River–Capricorn Coast
• St Helens Beach–Cape Hillsborough–North of Mackay
• Trinity Bay–Cairns
• net free north area
• northern Gulf waters
• Pormpuraaw waters
• Topsy Creek
• Norman River
• western Gulf waters.
A commercial fisher must not in the regulated waters—
possess a relevant net for taking a fish for trade or commerce, unless the net is stowed and secured on a boat; or
use a relevant net to take a fish for trade or commerce.

However, subsection (2) does not apply to a commercial fisher using a relevant net under an A1 licence.
Also, subsection (2) does not apply to a commercial fisher using a relevant net in a relevant area if the net is being used—
under an A2 licence; or
under a N11 licence to take fish under the licence other than for sale under the licence; or
in the N11 fishery to take N11 fish without the fishery symbol ‘N11’ being written on the licence other than for sale under the licence.
In this section—
relevant area means—
the net free north area; or
northern Gulf waters; or
Pormpuraaw waters; or
Topsy Creek; or
Norman River; or
western Gulf waters.
relevant net means a cast net, mesh net, seine net or set pocket net.
