46.02 Form of application
(1)
An application in a proceeding made on notice to any person must be made on summons, unless the Court otherwise orders, and must be supported by an affidavit or affidavits.
(2)
An application by summons is made when the summons is filed in accordance with Rule 46.04.
(3)
An application not by summons is made when it comes on for hearing.
