61.02 Application under section 6 or 8
(1)
An application under section 6 or 8 of the Act must—
(a)
be in Form 61A;
(b)
if made by a judgment debtor, be accompanied by a Statement of Affairs in Form 61B or in Form 61C if the judgment debtor is a corporation;
(c)
be filed.
(2)
An affidavit or declaration of service of an application under section 6 or 8 must be filed within a reasonable time after service of the application.
(3)
If an applicant under section 8 of the Act fails to comply with paragraph (2)—
(a)
the applicant must be taken to have abandoned the application; and
(b)
the proper officer must give notice in writing to the applicant of that abandonment.
