50.01 Definitions

In this Order—

acceptable mediator means a person determined under Rule 50.02 as an acceptable mediator;

appropriate dispute resolution means a process attended, or participated in, by a party for the purposes of negotiating a settlement of a civil proceeding or resolving or narrowing the issues in dispute, including, but not limited to—

(a)

pre-hearing conference;

(b)

mediation;

(c)

early neutral evaluation;

(d)

settlement conference;

complaint includes counterclaim and third party notice;

defence includes defence to counterclaim and defence to third party notice;

defendant includes a party who files a counterclaim or a defence to third party notice;

mediation report means a notice in Form 50A;

plaintiff includes a party who files a counterclaim or a third party claim;

the Court means the court constituted by—

(a)

a magistrate; or

(b)

a judicial registrar, or

(c)

a registrar;

third party includes any subsequent party.
