8A.04 Referral of disputes—section 39(1) of the Planning and Environment Act 1987
(1)
A referral under section 39(1) of the Planning and Environment Act 1987 must comply with the requirements set out in Rule 8A.03.
(2)
The referral must also contain—
(a)
the date on which the person became aware of the alleged failure to comply; and
(b)
the name of the Minister, planning authority or panel alleged to have failed to comply with Division 1, 2 or 3 of Part 3, or Part 8, of the Planning and Environment Act 1987.
