Duration of licences
32 Duration of licences
Subject to subsections (2), (3), (4) and (5), a licence continues in force for all purposes, unless —
surrendered under section 94; or
cancelled by the Director under this Act,
but may be surrendered, as a condition of and on the coming into force of, another licence granted by way of transfer or removal of that licence.
Even if —
the licensee may cease to carry on business under the licence; or
a business continuity order has effect; or
an interim authorisation has effect under section 86,
a licence remains in force, for all other purposes, subject to subsection (1).
A special facility licence expires —
where it is expressed to be granted for a specific period, when that period has elapsed; or
where the Director determines that a special facility licence is no longer necessitated, on a date specified by the Director in a notice in writing given to the licensee.
An occasional licence expires in accordance with its terms, or where the occasion in respect of which it was granted has taken place, or on the period during which it was specified to have effect having elapsed.
A licence the operation of which is suspended continues in force and is capable of being removed or transferred, but does not during the period of suspension authorise the sale of liquor.
The suspension of the operation of a licence does not affect liabilities incurred by the licensee under this Act up to the date on which the suspension takes effect.
