Temporary removal or redefinition of licence
80 Temporary removal or redefinition of licence
Where any licensed premises are, wholly or partially, rendered incapable of use for the business carried on there under the licence by reason of —
fire or other unforeseen or unavoidable calamity; or
being repaired or rebuilt, or for the time being required for any public purpose,
the licensee may, on informal application in writing being made to the Director, apply for a removal of the licence temporarily, for a period not exceeding 12 months, to some other portion of the premises or to other premises in the vicinity, or for a redefinition of the licensed premises for that period.
An application made under subsection (1) may be granted by the Director even if —
any premises to which the licence is to be temporarily removed, or the redefinition of the premises, would not, ordinarily, conform to the requirements of the Director; or
consents that would normally be required have not been obtained; or
no opportunity for objection has been afforded.
Where the Director is of the opinion that a removal of a licence under subsection (1) is not appropriate, the Director may suspend the operation of the licence or may redefine the licensed premises even if the application made was in respect of a temporary removal.
