Termination of certain leases and licences granted by Crown land managers
3.43 Termination of certain leases and licences granted by Crown land managers
A lease or licence granted by a Crown land manager over dedicated or reserved Crown land terminates if the dedication or reservation over the whole or part of the land is revoked unless the notice of revocation provides differently.
If a proposed revocation would affect only part of the land under a lease or licence, the Crown land manager and the holder of the lease or licence may agree that the lease or licence is to continue in force as if it had never been granted in relation to that part.
If an agreement is entered under subsection (2), the lease or licence—
does not terminate, and
continues in force, from the time of the revocation, in accordance with the agreement.
No compensation is payable for the termination of a lease or licence by operation of this section.
