5.39 Cancellation of enclosure permit and removal of structures
(1)
The Minister may, by written notice served on the holder of an enclosure permit—
(a)
cancel the permit or direct that section 5.36 does not apply to an enclosure (or both), and
(b)
order the former holder of the enclosure permit to remove any fence, gate or other structure on any Crown road or Crown watercourse within a specified period.
(2)
A former holder of an enclosure permit must comply with an order served under this section on the former holder.
Maximum penalty (subsection (2))—
(a)
for a corporation—100 penalty units, or
(b)
for an individual—20 penalty units.
