16 Exemptions from holding a licence
The Secretary, by notice published in the Government Gazette, may exempt a person or a class of person from the requirement to hold—
a management licence in respect of the radiation practice specified in the notice; or

a use licence in respect of the use of a radiation source specified in the notice; or
S. 16(1)(c) inserted by No. 59/2013 s. 8(2).
a facility construction licence in respect of a radiation source specified in the notice.
An exemption may be of general or specific application.
The Secretary may only exempt a person under subsection (1) if he or she is satisfied that the radiation practice or use will not pose a significant risk to the health or safety of any person or the safety of the environment.
An exemption is subject to the terms, conditions and limitations that are specified in the notice.

Without limiting subsection (4), an exemption may be subject to a condition requiring a person or class of person to comply with a document, code, standard, rule or guideline formulated, issued, prescribed or published by any person or body whether—
as formulated, issued, prescribed or published at the time notice of the exemption is published in the Government Gazette or at any time before notice of the exemption is published in the Government Gazette; or
as published or amended from time to time.
