Publication and duration of determinations
40N Publication and duration of determinations
A fishing determination made by the Secretary is to be notified by publication in the Gazette.
The determination takes effect on the date (on or after that publication) that is specified in the determination.
The determination has effect for the period specified in the determination or, if no such period is specified, until it is revoked by another fishing determination.
However, if the regulations require a fishing determination to be made for a period and no fishing determination has been made by the start of that period, the fishing determination for the immediately preceding period is taken to continue to have effect until a new fishing determination is made.
