Retirement Villages Act 1986

The operator of a retirement village must maintain each item of capital for which the operator is responsible in a reasonable condition having regard to the following—

the age of the item;

the prospective life of the item;

the maintenance charges paid to the operator by the residents of the retirement village.

If it is not practical to maintain an item of capital in accordance with this section, the operator may replace the item.

The operator of a retirement village must carry out the maintenance of, or replace, an item of capital for which the operator is responsible within a reasonable time after becoming aware of the need for the maintenance or replacement of the item.
