38BT Variation of services or facilities
(1)
The operator of a retirement village may vary a service or facility in accordance with a special resolution passed at a meeting of the residents of the retirement village—
(a)
as soon as possible after the passing of that resolution; or
(b)
if the resolution specifies a date on which the variation is to take effect, on that specified date.
(2)
Despite anything to the contrary in the terms of any residence contract or management contract, the operator does not breach the contract if the operator varies services or facilities in accordance with this Division.
