Requirements for village dispute procedure

Current

The operator of a retirement village must not establish or maintain a village dispute procedure that does any of the following—

(a)

enables the operator to take any action that—

(i)

is without the consent of a resident who is a party to the dispute; or

(ii)

duplicates, is inconsistent with or purports to override any other law; or

(iii)

duplicates, is inconsistent with or purports to override the provisions of any contract between a party to the dispute and the operator or proprietor of the retirement village; or

(b)

requires notification of a village dispute to be in writing;

(c)

prevents a resident who is a party to a village dispute from being represented by another person when dealing with the dispute.

Penalty: 60 penalty units.
