Effect of amalgamation on instruments
140 Effect of amalgamation on instruments
From an amalgamation day for an amalgamated organisation, the following instruments continue to have effect—
an instrument that—
a deregistered organisation is a party to; or
was given to, by, or in favour of a deregistered organisation; or
refers to a deregistered organisation;
an instrument under which—
money is, or may become, payable to or by a deregistered organisation; or
property may be disposed of to or by a deregistered organisation.
For acts, omissions, transactions and matters done on or after the amalgamation day, the instrument applies as if a reference in the instrument to a deregistered organisation were a reference to the amalgamated organisation.
