Before votes are counted, a scrutineer may advise the manager of the election the scrutineer considers an error has been made in conducting the ballot.

When votes are counted, a scrutineer may—

object to a ballot paper being admitted as formal or rejected as informal by the manager of the election; or

advise the manager of the election that the scrutineer considers an error has been made in conducting the ballot or counting votes.

If a scrutineer advises the manager under subsection (1) or (2)(b), the manager must—

decide whether the error has been made; and

if appropriate—direct action be taken to correct or mitigate the error.

If a scrutineer objects under subsection (2)(a), the manager must—

decide whether the ballot paper is to be admitted or rejected; and

note the decision on the ballot paper and initial the note.
