Transport Infrastructure Act 1994

This section applies to abandoned property found at the port authority’s or port operator’s port facility, unless—

it is insufficient value property; or

it is perishable and it is impracticable for the port authority or port operator to keep it having regard to its nature and condition.

The port authority or port operator—

must take reasonable steps to locate the owner of the property; and

may have the property moved to a place it considers appropriate.

If the port authority or port operator has located the owner of the property within 28 days after the property was found, the port authority or port operator must give the owner a written notice—

describing the property; and

stating the property has been found; and

explaining how it may be recovered; and

stating the property may be sold or disposed of if it is not recovered.

If the port authority or port operator has not located the owner of the property within 28 days after finding the property, the port authority or port operator must publish a notice in a newspaper circulating generally in the State that includes the matters mentioned in subsection (3)(a) to (d).
