451 Special requirement for child under 14
This section applies if a police officer reasonably suspects the relevant person is a child who is under 14 years.
The police officer may ask a parent of the child to give a forensic procedure consent for the child.
If the parent gives a forensic procedure consent for the child authorising the taking of a sample for DNA analysis, the sample taken must be a DNA sample and not a sample of the child’s blood.
Subsection (5) applies if the parent gives a forensic procedure consent for the child relating to the performance of a non-intimate forensic procedure.
Before the procedure is performed a police officer must ask the child whether the child wants a support person to be present while the procedure is being performed and, if the child wants a support person to be present, must ensure a support person is present while the procedure is being performed.
