Police Powers and Responsibilities Act 2000

The Minister may, for the State, make an arrangement with a declared agency, or a responsible Minister of another jurisdiction, relating to any of the following—

access by the declared agency or an entity of the other jurisdiction to DNA material held by the commissioner;

access by the commissioner to DNA material held by a declared agency or an entity of the other jurisdiction;

the use by the declared agency, an entity of the other jurisdiction or the commissioner of the DNA material.

An arrangement may recognise that access to, and comparison of, the results of DNA analyses may be by use of the ACC database.

The commissioner may, under an arrangement made under this section, provide access to DNA material held by the commissioner or stored on the ACC database to a declared agency or an entity of another jurisdiction.

The commissioner may use DNA material to which the commissioner has access under an arrangement made under this section for performing any function of the police service.

In this section—DNA material means—

the results of DNA analyses of things whether or not stored on a database; or

things on which DNA analyses have been performed.

responsible Minister, of another jurisdiction, means a Minister of the Commonwealth or another State responsible for the administration of a law that authorises the taking of a sample for DNA analysis.
