What person must be told before forensic examiner performs a forensic procedure
503 What person must be told before forensic examiner performs a forensic procedure
Before a forensic examiner performs a forensic procedure on a person, a police officer must tell the person—
if the procedure is authorised under a forensic procedure order—a forensic procedure may be performed on the person without the person’s consent because a forensic procedure order authorises its performance; and
that the person has the right to have 2 people (each of whom is an independent person) of the person’s choice present while it is being performed; and
that, for exercising the right mentioned in paragraph (b), the person may—
telephone or speak to a friend or relative to inform the friend or relative of the person’s whereabouts and ask the friend or relative to be present while the procedure is being performed; and
telephone or speak to a lawyer and arrange, or attempt to arrange, for the lawyer to be present while the procedure is being performed.
