789AF Costs
(1)
A court that makes a forced muster order may—
(a)
order the payment of costs in relation to the application for the order; or
(b)
reserve costs in relation to the application.Example for paragraph (b)—reserve costs of the application until the court is informed by affidavit of the result of any muster conducted under the order
(2)
Without limiting subsection (1)(a), if the court is satisfied by the result of any muster conducted under the forced muster order that it was inappropriate to apply for the order, the court may order the applicant to pay the costs of the application.
