Police Powers and Responsibilities Act 2000

A respondent for a police banning notice may apply, in the approved form, to the commissioner to amend or cancel the notice—

if the application relates to an initial police banning notice—within 15 days after the notice takes effect; or

otherwise—at any time.

Without limiting subsection (1), the respondent may apply to the commissioner on the ground that the police banning notice—

prevents the respondent from entering, remaining in, or using a mode of transport to travel to, the respondent’s residence, place of employment or place of education; or

is causing, or will cause, undue hardship to the respondent or a member of the respondent’s family.

The respondent must give the commissioner sufficient information with the application to enable the commissioner to decide the application.
