160 Determination of application for amalgamation
The Minister may grant an application to amalgamate 2 or more corporations if—
the Minister is satisfied that the purpose of the amalgamated corporation is to provide, maintain or operate any or all of a water supply system, water distribution system or drainage system, and
the corporation and any proposed works plan or rules of the corporation comply with any requirements of this Act and the regulations.
The amalgamated corporation is to be constituted by the Minister by order published on the NSW legislation website.
In addition to constituting the corporation, the order must specify the following—
the name of the corporation,
the water supply, water distribution or water drainage purposes of the corporation,
the landholdings for which the corporation may exercise functions and the works plan of the corporation,
the members of the corporation,
the board members of the corporation, pending the first election of board members,
the date, time and place for the first election of the board members of the corporation,
the rules of the corporation.
On the order being published or on such later day as may be specified in the order—
the new corporation is constituted as a body corporate with the name specified in the order, and
the members specified in the order are the members of the corporation, and
the rules and works plan specified by the order take effect, and
the amalgamated corporations are abolished, and
the new corporation is taken for all purposes to be a continuation of and the same legal entity as each of the amalgamated corporations.
The new corporation is not a NSW government agency.
