91E Carrying out controlled activity without, or otherwise than as authorised by, a controlled activity approval
A person must not, in, on or under waterfront land, carry out a controlled activity for which the person does not have a controlled activity approval.
Maximum penalty—Tier 2 penalty.
Maximum civil penalty—Tier C civil penalty.
The holder of a controlled activity approval must not, in, on or under waterfront land, carry out a controlled activity other than as authorised by the approval.
Maximum penalty—Tier 2 penalty.
Maximum civil penalty—Tier C civil penalty.
Without limiting subsection (2), a person carries out a controlled activity otherwise than as authorised by a controlled activity approval if the person carries out such an activity while the approval is suspended.
This section does not prevent a person—
from constructing and using a water management work in accordance with a water management work approval, or
from carrying out an aquifer interference activity in accordance with an aquifer interference approval.
