94 Determination of applications affected by reviews by Planning Assessment Commission
This section applies to any application for an approval in respect of which the Independent Planning Commission of New South Wales has given notice of a review under the Environmental Planning and Assessment Act 1979 to the Minister before the Minister makes a decision on the application.
The Minister—
must refer to the Independent Planning Commission of New South Wales—
the application (including any information furnished in relation to the application), and
any objection to the application (including any information furnished in relation to the objection),
whether the application or objection is made or lodged before or after the notice is received, and
must defer making any decision on the application until it receives the Commission’s report under the Environmental Planning and Assessment Act 1979.
In making a decision on the application, the Minister must have regard to the findings and recommendations contained in the Commission’s report under the Environmental Planning and Assessment Act 1979.
