367D Evidence from photographs and other images
This section applies to a photographic or other image of an area of land formed from data captured by a device carried by an aircraft, satellite or other craft, and information recorded on the image, that the Minister certifies as an approved image.
The approved image is admissible in proceedings under this Act and, in the absence of evidence to the contrary, is evidence of the following—
the matter depicted on the image,
the information recorded on the image relating to the location or boundaries of the land,
the time when, or the period during which, the image was taken,
other matters prescribed by the regulations.
In proceedings in which the approved image is admitted in evidence—
the image is presumed, in the absence of evidence to the contrary, to be orthorectified, and
evidence is not required, in the absence of evidence to the contrary, of the accuracy of a process used to—
orthorectify the image, or
determine the boundaries of land recorded in the image.
This provision refers to the regulations (prescribed by the regulations
