346A Contravention of terms and conditions of bore driller’s licence
The holder of a bore driller’s licence must ensure that the terms and conditions of the licence are not contravened.
Maximum penalty—Tier 2 penalty.
Maximum civil penalty—Tier C civil penalty.
It is a defence to proceedings under subsection (1) if the person establishes—
that the contravention of the term or condition was caused by a person other than the holder of the bore driller’s licence, and
that the holder took all reasonable steps to prevent the contravention of the term or condition.
A person who is a trainee driller carrying out bore drilling under the supervision of the holder of a bore driller’s licence must not contravene the terms and conditions of the licence.

It is a defence to proceedings under subsection (3) if the person establishes that the person took all reasonable steps to prevent the contravention of the term or condition.
