Water Management Act 2000

Sections 53 and 54, as substituted by Schedule 1.3 to the amending Act, extend to existing dams.

An existing dam is a dam that was in existence immediately before sections 53 and 54 were substituted by Schedule 1.3 to the amending Act.

However, nothing in this clause permits the capturing and storage of water in, or the taking and use of water from, an existing dam in accordance with substituted sections 53 and 54 if the dam was not lawfully constructed and continues to be unlawful.
