The Minister may impose discretionary conditions on an access licence after it has been granted, but only if the Minister—

has given written notice to the holder of the access licence that the Minister proposes to impose such conditions, and

has given the holder of the access licence a reasonable opportunity to make submissions to the Minister with respect to the proposed conditions, and

has taken any such submissions into consideration.

Subsection (1) does not apply to conditions imposed on an access licence—

at the request of the holder of the access licence, or

as a result of action taken under section 66 (3), or

when the access licence is amended under section 68B, or

in connection with a dealing under Division 4.

Mandatory conditions referred to in section 66 (1) (a) of an access licence may be imposed, amended, revoked or suspended by the Minister whenever it is necessary to do so in order to enable compliance with or to give effect to this Act, the regulations or a relevant management plan.

The Minister must cause written notice of any conditions imposed, amended, revoked or suspended under this section to be served on the holder of the access licence concerned.

A condition imposed or a change referred to in subsection (4) takes effect on the day on which the notice referred to in that subsection is served on the holder of the access licence or on such later day as may be specified in the notice in that regard.

The regulations may make provision for or with respect to the manner in which written notices may be given for the purposes of this section.
