370A Certain activities excluded
The Court must not find an individual has contravened a civil penalty provision if the individual’s conduct was one or more of the following—
taking water for domestic consumption or stock watering,
installing a flood work solely to protect a dwelling,
undertaking, for the sole purpose of providing access to a dwelling, a controlled activity that does not involve impounding water,
an activity prescribed by the regulations.
This section does not apply to an individual taken to have contravened a civil penalty provision in accordance with section 370C or 370D.
In this section—
domestic consumption, in relation to land, includes domestic consumption within the meaning of section 52.
stock watering, in relation to land, includes stock watering within the meaning of section 52.
This provision refers to the regulations (prescribed by the regulations
