353FA Recovery of monetary benefits from related persons
This section applies if the Land and Environment Court finds a corporation has contravened a provision of this Act or the regulations.
The Minister may apply to the Court for an order that a related person of the corporation pay an amount estimated to be the monetary benefit obtained by the related person as a result of the contravention.
The Court may, in making an order under this section, take the matters in section 353F(2) into account.
The Court may make an order under this section only if satisfied, on the balance of probabilities, that the related person obtained the estimated monetary benefit as a result of the contravention.
