Duration of conference or ADR
427 Duration of conference or ADR
If a conference election notice is given under section 426(2)(a), the authorised officer directed under section 428 to conduct the conference must take all reasonable steps to facilitate the resolution of the dispute within 30 business days after the notice is given (the usual period).
If an ADR election notice is given under section 426(2)(b), the parties must use all reasonable endeavours to resolve the dispute within 30 business days after the notice is given (also the usual period).
Either party may, within the usual period, ask the other party to agree to a longer period to apply instead of the usual period.
If the parties agree to the longer period, that period applies instead of the usual period.
If an ADR is called for, sections 430 and 433 apply to the ADR as if a reference in the sections to a conference were a reference to an ADR.
