Water Act 2000

This section applies if a person is convicted of an offence against section 615 in relation to the incurring of a debt by a water authority.

The Supreme Court or the District Court may declare that the person is to be personally responsible, without any limitation of liability, for the payment to the authority of the amount required to satisfy the part of the authority’s debts that the court considers appropriate.

This section does not affect any rights of a person to indemnity, subrogation or contribution.

This section—

is in addition to, and does not limit, any rule of law about the duty or liability of a person because of the person’s office in relation to a water authority; and

does not prevent proceedings being started for a breach of the duty or the liability.
