Who may give a compliance notice

In force

(1)

This section applies if the chief executive or an authorised officer reasonably believes—

(a)

a person—

(i)

is contravening a provision of this Act; or

(ii)

has contravened a provision of this Act in circumstances that make it likely the contravention will continue or be repeated; and

(b)

a matter relating to the contravention is reasonably capable of being rectified; and

(c)

it is appropriate to give the person an opportunity to rectify the matter.

(2)

The chief executive or authorised officer may give the person a notice (a compliance notice) requiring the person to refrain from doing an act or to rectify the matter.
